DMCA & Copyright Policy

Welcome to Gyaniva. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following process to address claims of copyright infringement.

1. Statement of Intent

Gyaniva is an educational archive created to help students access previous year question papers for academic and competitive exam preparation. We do not claim ownership of the official question papers provided by boards (WBBSE, WBCHSE, UPSC, etc.) or Universities. These materials are shared under Fair Use guidelines for educational, non-commercial purposes.

2. How to File a Takedown Notice

If you are a copyright owner or an authorized agent and believe that any content on Gyaniva infringes upon your copyrights, you may submit a written notification pursuant to the DMCA by providing our Copyright Agent with the following information:

  • Identification of the copyrighted work: A clear description of the work you claim has been infringed.
  • Identification of the infringing material: The specific URL(s) on our site where the material is located so we can find and remove it.
  • Contact Information: Your full name, mailing address, telephone number, and email address.
  • Good Faith Statement: A statement that you have a "good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
  • Signature: A physical or electronic signature of the copyright owner or authorized representative.

3. Our Response Procedure

Upon receipt of a valid and complete DMCA notice, Gyaniva will:

  • Expeditiously remove or disable access to the allegedly infringing material.
  • Notify the user who posted the content (if applicable) that the material has been removed.
  • Maintain a record of the takedown.

4. Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may send us a counter-notice. This must include your contact details, identification of the removed material, and a statement under penalty of perjury that you have a good faith belief the material was removed in error.

5. Repeat Infringer Policy

Gyaniva takes copyright seriously. We reserve the right to terminate access for any user or contributor who is determined to be a "repeat infringer" of the copyrights of others.
